ACCEPTANCE OF THE TERMS OF USE

These terms of use are entered into by and between you and the ARICHAIN Service (”ARICHAIN”, “Service”, ”we”, “our” or “us”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these "Terms of Use"), govern your access to and use of including any content, functionality and services offered on or through arichain.com, ARICHAIN Explorer, ARICHAIN Developer, ARICHAIN Wallet (together, the “Website”) and ARICHAIN Wallet Application ("App").

Please read the Terms of Use carefully before you start to use the ARICHAIN. By using the ARICHAIN or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, incorporated herein by reference. If you do not to agree to these Terms of Use or the Privacy Policy, you must not access or use the ARICHAIN.

CHANGES TO THE TERMS OF USE

We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the ARICHAIN hereafter.

Your continued use of the ARICHAIN following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page each time so you are aware of any changes, as they are binding on you.

WHO MAY USE THE WEBSITES

This Website is offered and available to user who are at least 13 years of age or older. The Website is not intended for children under 13 years of age.

If you are accepting these Terms of Use of behalf of a Website or other legal entity, you represent and warrent that you (i) are at least 13 years old or older. ACCOUNTS

You need to create an account with ARICHAIN to use the Services. When you create an account, we will ask your for some information about yourself. We may require you, in our sole discretion, to provide additional information and/or documents. If you do not provide complete and accurate information and/or documents in response to such a request, we may refuse to provide you with the Services. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Website.

ARICHAIN account refers to a login account you need to use the Websites and App. ARICHAIN account is required to use for the Service, and the Master Key is provided to you when you first sign up.
YOU MUST NEVER GIVE OR REVEAL THE MASTER KEY TO ANYONE. IT HAS ACCOUNT RECOVERY AND KEY CHANGES. UNLESS YOU WANT THAT PERSON/MACHINE TO HAVE ACCESS TO ALL THE RIGHTS, ACCOUNTS AND FUNDS OF THE ADRESSES THAT ARE GENERATED FROM THAT KEY.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

You are responsible for safeguarding the password that you use to access the Websites and for any activities or actions under your password, whether your password is with this website. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

ARICHAIN account is only available to you and cannot allow anyone else to use it. You also have to manage your password your own so that no one else could access to it without permission. If you suspect an unauthorized access, please notify ARICHAIN immediately. If an unauthorized person logged in with your account information, all activities that occur in your account are considered entirely your responsibility, and ARICHAIN is not responsible for any losses that may result.

ELIGIBILITY

You must be at least 18 years of age and have reached the legal age of majority in the country in which your account is registered to use any Websites. By using this Websites and by agreeing to this Agreement you warrant and represent that you are at least 18 years of age.

If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.

We may, but have no obligation to, monitor and review new accounts before you may sign in and start using the Services. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

We may update the content on this Websites from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Websites may be out of date at any given time, and we are under no obligation to update such material.

Further, all rights to this Website, its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned and controlled by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Use permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, LICENSORS, SUPPLIERS OR ANY THIRD PARTIES MENTIONED AT THE WEBSITE BE LIABLE FOR ANY INCIDENTAL, INDIRECT, EXEMPLARY, PUNITIVE AND/OR CONSEQUENTIAL DAMAGES, LOST PROFITS, AND/OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION RESULTING FROM THE USE OF AND/OR INABILITY TO USE THE WEBSITE, THE ARICHAIN , SYSTEMS, INFORMATION, SERVICES OR THE CONTENT WHETHER BASED ON WARRANTY, CONTRACT, TORT, DELICT, OR ANY OTHER LEGAL FOUNDATION, AND WHETHER OR NOT ARICHAIN IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY LAW, THE REMEDIES STATED FOR YOU IN THESE TERMS OF USE ARE EXCLUSIVE AND ARE LIMITED TO THOSE EXPRESSLY PROVIDED FOR HEREIN.

INDEMNIFICATION

You agree to indemnify and hold harmless our company and its officers, directors, service providers, predecessor, successor in interest, employees, agents, contractors, representatives andaffiliates, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Website, including, but not limited to, your user contributions, any use of the Website’s content, services, and products other than as expressly authorized in these Terms of Use or your use of any information obtained from the Website.

SEVERABILITY

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any term of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, the remaining terms shall remain in full force and effect.

DISPUTE RESOLUTION

You agree that all matters relating to your access to or use of the ARICHAIN, including all disputes, will be governed by the laws of the United States and by the laws of the State of California without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and federal courts in California, and waive any objection to such jurisdiction or venue. The preceding provision does not apply if you are a consumer based in the European Union. If you are a consumer based in the European Union, you may make a claim in the courts of the country where you reside. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. Claims made under the separate terms and conditions of services are not subject to this limitation. No recovery may be sought or received for damages, except that the prevailing party will be entitled to costs and attorneys’ fees. In the event of any controversy or dispute between ARICHAIN and you arising out of or in connection with your use of the ARICHAIN, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

CHANGES AND AMENDMENTS

We reserve the right to change or modify any of the terms and conditions contained in the Terms or any policy or guideline of the Websites and App, at any time and in our sole discretion. Any changes or modification will be effective immediately upon posting of the revisions on the Websites and App, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued use of these Websites and App following the posting of changes or modifications will confirm your acceptance of such changes or modifications.

ACCEPTANCE OF THESE TERMS

Customer shall be solely responsible for its actions and the actions of its users while using the ARICHAIN. Customer acknowledges and agrees: (a) to abide by all local, state, national, and international laws and regulations applicable to Customer’s use of the ARICHAIN, including without limitation the provision of Customer Data; (b) not to send or store data on or to the ARICHAIN which violates the rights of any individual or entity established in any jurisdiction. If you do not agree to these terms, we advise you not to use our ARICHAIN immediately to avoid any conflicts in the future.

This privacy policy (“Policy”) describes how the personally identifiable information (“Personal Information”) you may provide on the arichain.com (“Website” or “Service”) and any of its related services (collectively, “Services”) is collected, protected and used. It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy is a legally binding agreement between you (“User”, “you” or “your”) and ARICHAIN. (“ARICHAIN”, “we”, “us” or “our”). By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

AUTOMATIC COLLECTION OF INFORMATION

When you use the Website, we automatically record information that your browser sends. This data may include information such as your device’s IP address, browser type, and version, operating system type and version, language preferences or the webpage you were visiting before you came to the Website and Services, pages of the Website and Services that you visit, the time spent on those pages, the information you search for on the Website, access times and dates, and other statistics.

Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding the usage and traffic of the Website and Services. This statistical information is not otherwise aggregated in such a way that would identify any particular user of the system.

• e-commerce provider such as payment solution providers to assist us in the processing of your online payments.

The said third party companies are obliged to protect your data to the same extent as we are. If the level of data protection in a country does not correspond to the level of data protection in Switzerland or European Union, we ensure by contractual means that the protection of your personal information corresponds to that in Switzerland or the European Union all times by concluding agreements using the standard contractual clauses and complying with the GDPR.

MANAGING PERSONAL INFORMATION

You are able to access, add to, update and delete certain Personal Information about you. The information you can view, update, and delete may change as the Website or Services change. However, when you update information, we may maintain a copy of the unrevised information in our records.

We cannot respond to your request or provide you with Personal Information unless we first verify your identity or authority to make such a request and confirm that the Personal Information relates to you.

PRIVACY OF CHILDREN

We do not knowingly collect any Personal Information from children under the age of 13. If you are under the age of 13, please do not submit any Personal Information through the Website and Services. If you have reason to believe that a child under the age of 13 has provided Personal Information to us through the Website and Services, please contact us to request that we delete that child’s Personal Information from our Services. You must also be at least 18 years of age to consent to the processing of your Personal Information in your country (in some countries, we may allow your parent or guardian to do so on your behalf).

EMAIL MARKETING

We offer electronic newsletters to which you may voluntarily subscribe at any time. We are committed to keeping your email address confidential and will not disclose your email address to any third parties except as allowed in the information use and processing section or for the purposes of utilizing a third-party provider to send such emails. We will maintain the information sent via email in accordance with applicable laws and regulations.

In compliance with the CAN-SPAM Act, all emails sent from us will clearly state who the email is from and provide clear information on how to contact the sender. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails or by contacting us.
